Portuguese Law no. 32/2021 fixes the font size of standard contractual clauses
Portugal IP Alert
Portuguese Law no. 32/2021, published on May 27, foresees an obligation for standard terms to be written in a font size not inferior to 11 or to 2,5 millimeters and with a line spacing not inferior to 1,15 in order to allow consumers to have effective knowledge of the terms they are agreeing to.
The Portuguese Government has now 60 days to rule this law and the same enters into effect 90 days after its publication (on August 25, 2021). Standard terms will have to be adapted accordingly, otherwise they will be found null and void.
Additionally, the Law foresees that a system should be implemented that oversees the use of abusive clauses and that an administrative system must be created that controls and prevents the use of such clauses, notably when the same have been found prohibited by a court decision.
