Elena Martín is a senior associate in the Intellectual Property Department at Garrigues, where she joined as a patent attorney in the area of life sciences and chemistry. She specializes in providing technical advice on the drafting, prosecution and management of patent rights, both nationally and internationally, in accordance with the patent granting procedures of the SPTO, EPO and USPTO, as well as the PCT procedure. She also specializes in drafting patentability, Freedom to Operate (FTO), invalidity and infringement reports. She also participates as technical support for the legal department of Industrial and Intellectual Property in legal proceedings for infringement and invalidity of patent rights. Her main activity is focused, due to her academic training, on advising companies in the biotechnology and pharmaceutical sector, although she has experience in other sectors such as petrochemical, food or agrochemical. She is also a European Patent Attorney (EQE).
Experience
Elena Martín began her career in the IP department of a biopharmaceutical company in 2005 and continued as a patent attorney in several renowned firms in the field of IP. She has extensive experience in advising on IP management, both for companies and research centers. Specifically, her experience includes
- Technical advice on the drafting, prosecution and management of patent rights, in accordance with the patent granting procedures of the Spanish Patent and Trademark Office (SPTO), European Patent Office (EPO) and procedures in other countries, as well as in the PCT (Patent Cooperation Treaty) procedure.
- Strategic advice on the protection of inventions at national and international level.
- Drafting of patentability, invalidity, infringement and FTO (Freedom To Operate) reports.
- Technical support in the IP part of Due Diligences.
She is fluent in English and has knowledge of German.

- Degree in Biochemistry from the Complutense University of Madrid.
- Academic year at the Humboldt University of Berlin.
- Master's Degree in Biotechnology.
