Javier García Fernández is a principal associate in the Litigation and Arbitration practice. He specializes in civil procedural law, inheritance law and contract law.
He has a law degree from Universidade de Santiago where he pursued doctoral studies. He has practiced as a lawyer since 2004 and has extensive forensic experience, particularly in the civil jurisdiction, in a variety of arbitration proceedings and in advising individuals and companies in civil and corporate/commercial law.
He regularly handles particularly complex and/or relevant civil proceedings.
He has successfully handled extraordinary appeals in the civil jurisdiction at the Supreme Court and before the Constitutional Court.
Experience
Javier García Fernández has been a principal associate in the Litigation and Arbitration Department of Garrigues since 2022. He joined the firm in 2010.
He started practicing law at the beginning of 2004 and since then has specialized in acting as legal counsel in court proceedings in the civil jurisdiction and in handling ADR procedures before arbitral institutions.
He also has extensive experience in providing advice to companies and individuals, in all areas of civil law (Spanish and regional).
As part of his activities as a lawyer he has handled many singular and/or particularly complex court proceedings:
- Lawsuits involving successions and inheritances.
- Lawsuits resulting from various problems in the sphere of contracts law.
- Lawsuits involving rights in rem and real estate.
- Lawsuits in connection with contractual and non-contractual civil liability.
- Lawsuits related to insurance law.
- Lawsuits involving family law.
- Proceedings for the recognition and/or enforcement (exequatur) of foreign court decisions.
- Lawsuits involving corporate law.
- Lawsuits involving unfair competition.
- Lawsuits involving consumer affairs.
- Lawsuits related to the defense of the right to honor, personal and family privacy and personal portrayal.
He has also handled proceedings in the voluntary jurisdiction and dispute resolution arbitration proceedings.
The advisory services he provides to companies and individuals regularly involve drafting and analyzing a wide variety of contracts. His services in the area of inheritance planning of private parties are also worth noting, with the corresponding impact in the sphere of family business.
He speaks Spanish, Galician and English and has a knowledge of Portuguese.
