Javier Jimeno is a Principal Associate in the Litigation & Arbitration Department at Garrigues, where he carries out his professional activity sponsoring our clients in arbitration and judicial proceedings in civil and commercial, construction, investment, administrative and constitutional litigation matters.
He deals both with the management of complex litigation and with recurring advice on contractual and strategic matters, with extensive experience in advising companies in construction and hydrocarbons sector.
Graduated in Law from the Pontificia Universidad Católica del Perú and LL.M. in Arbitration and Business Law from Erasmus University Rotterdam, in the Netherlands.
Javier is a regular speaker at academic events related to the fields of his specialty. He has been a teaching assistant in courses on procedural matters and economic analysis of Law at the Pontificia Universidad Católica del Perú. Currently, he is a professor of the Introduction to Procedural Law course at the Law School of the University of Lima and of the Precautionary Measures course in the Master's Degree in Procedural Law at the University of San Martín de Porres.
Experience
Javier joined the Firm in 2018. As of 2023, he holds the position of Principal Associate. Since joining Garrigues, Javier has had a successful performance in multiple matters, among which the following stand out:
- Successful defense of a public benefit society in an arbitration concerning the termination of a concession contract for the construction and operation of a hotel in a building declared a cultural heritage site.
- Successful defense of oil consortium companies in an international commercial arbitration promoted by the Peruvian state agency in charge of promoting investment in hydrocarbons.
- Defense of a major construction company in an arbitration against a major mining company for reciprocal claims of US$ 11 MM, regarding the execution of an EPC Contract.
- Defense of an information technology company in an arbitration against a member company of a business group engaged in the provision of health services.
- Successful defense of a first-tier bank in the judicial process initiated to challenge the transfer of a loan portfolio valued at US$ 50 MM.
- Legal consulting to a construction company in a mediation procedure followed with a company of the mining sector, regarding the controversy on the execution of a construction contract for the construction of a mineral concentrator plant.
- Sponsorship of an airport operating company in a contentious-administrative proceeding against OSITRAN to challenge the rule that defines whether improvements related to non-major airport operations can be executed and financed through third parties.
- Representation of an airport operating company in a contentious-administrative proceeding against OSITRAN to question the maximum rate applicable to the use of passenger boarding and disembarkation bridges.
- Representation of an airport operating company in a contentious-administrative proceeding against OSITRAN to challenge the incorrect interpretation of the concession contract regarding the definition of the concept of "gross income", which is used to determine the amount to be paid to the Peruvian State as remuneration for the concession.
Academic background
Law Degree from Pontificia Universidad Católica del Perú (2012) and Master in Arbitration and Business Law from Erasmus University Rotterdam, The Netherlands (2018).
Teaching activity
