Rubén Magallares is a partner in the Litigation and Arbitration practice at Garrigues. He specialises in both the legal management of proceedings and pre-litigation strategy in commercial and civil matters. Specifically, the matters in which he has most experience relate to contractual and non-contractual liability disputes, corporate law, investment agreements and shareholders' agreements, unfair competition, damages arising from breaches of competition law and litigation relating to the marketing and distribution of financial products. He intervenes both before the ordinary courts and before various national and international arbitration institutions.
He was a collaborating lecturer on the Master's Degree in Access to the Legal Profession at the Universidad Autónoma de Madrid in 2012 and 2013 and, for several years now, he has been a lecturer on the Master's Degree in Access to the Legal Profession at Centro de Estudios Garrigues.
His most recent publications include one of the chapters of the Centro de Estudios Garrigues' Manual de Acceso a la Abogacía.
Experience
Rubén Magallares is a partner in the Litigation and Arbitration practice at Garrigues since January 2021. He has worked in Garrigues since 2006.
He has extensive experience in the legal management of civil and commercial proceedings, and has also collaborated in criminal and employment-related proceedings.
In particular, he has focused his work mainly on disputes relating to contractual and non-contractual liability, corporate law, investment agreements and shareholders' agreements, unfair competition, damages arising from breaches of competition law, as well as litigation relating to the marketing and distribution of financial products. He is involved in proceedings before both the ordinary courts and various national and international arbitration institutions.
In his professional activity he has been involved in highly complex litigation involving large multinationals, including, by way of example:
• Disputes concerning contract interpretation disputes, including clauses relating to force majeure and other possible causes for termination of distribution and supply contracts for products subject to long-term terms.
• Disputes relating to contract interpretation, including limitation of liability clauses.
• Litigation relating to claims for damages arising from infringements of competition law (trucks cartel, car manufacturers' cartel, abuse of dominant position, etc.).
• Corporate law litigation, including disputes relating to the right of withdrawal of shareholders, challenges to corporate resolutions.
• Liability disputes arising out of fires.
He also provides pre-litigation advice to clients aimed at trying to avoid litigation or, if that is not possible, to improve the client's legal position for such litigation. He also provides advice in coordination with other practices of the department in relation to corporate and tax transactions, etc.
He is fluent in Spanish and English.
Academic background
Degree in Law and Economics at Universidad Carlos III de Madrid (2006). Program on Oratory and Reasoning at Trials at same University (2006). Member of University of Carlos III de Madrid team in the Willem Vis Internacional Commercial Arbitration Moot Competition (2006). Anglo American Law Program (Centro de Estudios Garrigues, 2009).
