Regulatory compliance
In regulatory matters, we have highly specialized teams in all areas of activity (generation, transportation, distribution, and commercialization) that make up the electricity supply chain (including the field of renewable energy), as well as in the gas and oil sectors. Our advisory services also include assisting operators in relation to their participation in organized electricity and natural gas markets and the application of other possible remuneration regimes. Additionally, we have extensive experience in providing ongoing regulatory advice to major players in the nuclear sector in all aspects related to the operation of the nuclear power plants comprising the Spanish nuclear park, as well as in the management and storage of nuclear fuel and waste.
In all these areas, our advice primarily focuses on issuing reports and opinions on various regulatory issues (i.e. those related to the exercise of activities, the rights and obligations regime for system participants, their status as critical operators, or compliance with the regulatory regime for stakeholding in the energy sector). We participate in due diligence processes in the framework of national and international project finance and buying and selling transactions. We also provide advice in the processing of authorizations, permits, concessions, and other enabling titles, including the submission of necessary communications and responsible declarations when required. Additionally, we assist our clients in their interactions with the relevant authorities and major sector regulatory bodies (CNMC, CSN, OMEL/OMIE, MIBGAS), both regarding the regular development of their activities and in relation to any regulatory initiatives that may impact the applicable regime in different energy sectors. Finally, we also provide guidance to operators in all types of administrative procedures (including the sanctioning regime) and legal assistance in administrative litigation procedures at all levels, including the Constitutional Court.
