New mandatory record of employees from construction and agricultural industries is introduced

The uprising concerns regarding the enforcement and compliance with the health and safety at work rules, namely in farms and temporary or mobile construction sites, where a higher Covid-19 contagious risk and employees mobility exists, lead to the introduction of a daily mandatory record of employees.
Such record was introduced by Decree-law no. 29-A/2021, of April 29, and it must be done from April 30, 2021, onwards.
The employer with more than 10 employees in agricultural sites or temporary or mobile construction sites in Portuguese continental territory is now obliged to keep a daily record of all the employees at its service, with the following data:
- Full identification and residence;
- Taxpayer number;
- Social Security number;
- Phone number.
For temporary employees or service providers, it is the beneficiary company’s responsibility to keep those records.
The record must be available at all times to be consulted whenever requested by the labor authorities or by any other competent authority.
If the labor authorities identify an employee in a work site in violation of mandatory lockdown, shall report it to the competent authorities.
