Portugal: Promoting the rights of people with endometriosis or adenomyosis and implications for the absence regime
It was published in the official gazette Law no. 32/2025, of 27 March, which aimed to promote the rights of people with endometriosis or adenomyosis by strengthening their access to health care and creating a system of justified absences from work and classes by amending the Labour Code.
Article 252b has been added to the Labour Code, which states that an employee suffering from severe and disabling pain caused by endometriosis or adenomyosis during her menstrual period has the right to be absent from work on justifiable grounds, without loss of any rights, including retribution, for up to three consecutive days per month of work.
The medical prescription certifying endometriosis or adenomyosis with incapacitating pain is handed to the employer and constitutes proof of justifiable absence, without the need for monthly renewal.
This regime will come into force on April 26, 2025.
